Rental Terms and Conditions

These Rental Terms and Conditions (“Terms”) govern the rental of motorcycles from GS Adventure Colombia (“Company”) to the renter (“Lessee”). By renting a motorcycle from the Company, the Lessee agrees to abide by all the terms and conditions set forth below.

1. Definitions

• Company: GS Adventure Colombia, located at Carrera 43A #31 – 172 LOCAL INDEPENDIENTE, La Candelaria, Medellín, Colombia.
• Lessee: The individual renting the motorcycle.
• Motorcycle: The BMW GS 800 or BMW GS 1200 motorcycle is provided by the Company.
• Agreement: The Motorcycle Rental Agreement signed by the Company and the Lessee incorporates these Terms.

2. Eligibility Requirements

• Age: Lessee must be at least 25 years old.
• License: The lessee must hold a valid motorcycle driver’s license, which is accepted in Colombia.
• Experience: Lessee must have at least 2 years of experience riding motorcycles of similar size and power.
• Identification: Lessee must provide a valid passport or national ID and a valid credit card for the security deposit.

3. Rental Period

• The rental period begins at the date and time specified in the Rental Agreement and ends when the motorcycle is returned to the Company’s designated location.
• The Company must approve extensions to the rental period in writing at least 24 hours before the original return time.

4. Rental Rates and Payment

Daily Rental Rates:

• BMW GS 800: $140.00 per day
• BMW GS 1200: $180.00 per day

Mileage Allowance:

• 250 km per day included.
• Additional Kilometers:
  • BMW GS 800: $35.00 per each additional 100 km over the daily limit
  • BMW GS 1200: $50.00 per each additional 100 km over the daily limit

Payment:

• Full payment is due at the start of the rental period.
• Accepted payment methods: Credit card, debit card, or cash.

5. Reservations, Cancellation, and Refund Policy

5.1 Reservations

• A reservation is confirmed upon receipt of full payment and a signed Rental Agreement.

5.2 Cancellation Policy

• Cancellations Made 10 Days or More Before Rental Start Date:
  • The lessee is entitled to a full refund of the rental payment.
• Cancellations Made Between 10 and 5 Days Before Rental Start Date:
  • The lessee is entitled to a 50% refund of the rental payment.
• Cancellations Made Less Than 5 Days Before Rental Start Date:
  • No refund will be issued.

5.3 Refund Process

• Refunds will be processed within 14 days of receiving the cancellation notice.
• All cancellations must be submitted in writing via email to maxwell@gsadventurecolombia.com.

5.4 Modifications

• Date changes are subject to availability and must be requested at least 5 days before the rental start date.
• If the rental period is shortened within 5 days of the start date, no refund will be provided for the unused days.

6. Security Deposit

• A security deposit of $1,500.00 is required via credit card authorization.
• The deposit covers potential damages, losses, or additional charges incurred during the rental period.
• The deposit will be released within 21 days after the motorcycle is returned, less any applicable charges.

7. Use of Motorcycle

The Lessee agrees to:

• Operate the motorcycle safely and lawfully, adhering to all Colombian traffic laws and regulations.
• Use the motorcycle only within the permitted geographical area: Colombia.
• Not permit any other person to operate the motorcycle.
• Not use the motorcycle for any illegal activities, racing, or unauthorized off-road riding.
• Not carry passengers or cargo exceeding the motorcycle’s capacity.
• Not use the motorcycle under the influence of alcohol, drugs, or any other substance that may impair driving ability.

8. Maintenance and Care

• The Lessee shall maintain the motorcycle in good condition, regularly checking oil, coolant, and tire pressure.
• Any mechanical failures or issues must be reported immediately to the Company.
• The Lessee is responsible for all damages resulting from negligence, misuse, or failure to adhere to maintenance requirements.

9. Fuel Policy

• The motorcycle is provided with a full tank of fuel and must be returned full.
• A refueling charge of $25.00 will apply if the motorcycle is not returned with a full tank.

10. Late Return and Extensions

10.1 Late Return

• A late return fee is calculated at half the motorcycle’s daily rental rate for every half-day (up to 12 hours) overdue.

10.2 Extensions

• Extensions must be requested and approved in writing at least 24 hours before the original return time.
• Extensions are subject to availability and must be paid in advance.

11. Mileage Limitations

• Included Mileage:
  • 250 km per day.
• Excess Mileage Charges:
  • BMW GS 800: $35.00 per each additional 100 km over the daily limit.
  • BMW GS 1200: $50.00 per each additional 100 km over the daily limit.
• Mileage is calculated based on the motorcycle’s odometer readings at check-out and return.

12. Insurance and Liability

Insurance Coverage:

• • The motorcycle is fully insured with:

• Collision Damage

• Theft Protection

• Deductible: Lessee is responsible for 15% of the total cost of any damage or loss.

Lessee’s Responsibility:

• Responsible for all damages, losses, or theft up to the deductible amount.
• Must report any accidents, damages, or theft to the Company immediately.
• Must obtain a police report in the event of an accident or theft.

13. Traffic Violations and Fines

• Lessee is responsible for all traffic violations, fines, and penalties incurred during the rental period.
• Any fines received by the Company after the rental period, including an administrative fee, will be charged to the Lessee.

14. Breakdown and Assistance

• The Company provides 24/7 roadside assistance.
• In case of mechanical failure not caused by the Lessee, the Company will provide a replacement motorcycle if available.
• Lessee must not authorize repairs without the Company’s consent.

15. Damage, Loss, and Theft

• Lessee must take all reasonable measures to secure the motorcycle against theft or damage.
• In case of theft, Lessee must provide the keys and an official police report.
• Lessee is liable for damages resulting from negligence, misuse, or violation of these Terms.

16. Personal Property

• The Company is not responsible for any personal property left on or with the motorcycle.
• The lessee is advised not to leave valuables unattended.

17. Termination of Agreement

• The Company may terminate the rental agreement and repossess the motorcycle without notice if the Lessee breaches any terms.
• No refund will be provided in case of termination due to Lessee’s breach.

18. Indemnification

• Lessee agrees to indemnify and hold the Company harmless from all claims, liabilities, damages, losses, or expenses arising from the Lessee’s use of the motorcycle.

19. Governing Law and Jurisdiction

• The laws of Colombia govern these Terms.
• Any disputes shall be resolved in the courts of Medellín, Colombia.

20. Amendments

• Any amendments to these Terms must be made in writing and signed by both the Lessee and an authorized representative of the Company.

21. Severability

• If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Acceptance of Terms

By signing the Rental Agreement and taking possession of the motorcycle, the Lessee acknowledges having read, understood and agreed to these Rental Terms and Conditions.
